Patent Valuation
How much is my patent worth?
Regardless of whether you want to know how much your patent application is likely to be worth in licence negotiations, what price you can demand for your utility model in sales negotiations or which IP rights in your extensive portfolio could be better abandoned. Whether you need to determine the value of an employee invention or a patent for the non-cash formation of a limited liability company, in a legal dispute over claims for damages or to measure the success of your patent management:
We work with you to select the most efficient procedure and the appropriate scientifically sound methods so that you can derive the best possible benefit from your patent evaluation.
Scientifically sound evaluation and decision-making
Through a systematic and transparent approach to valuation, we determine a fair value that is recognised by experts, courts and tax authorities and can also be used by non-experts:
We analyse qualitative and quantitative factors covering the key areas of technology, law and profitability using a well-founded and needs-based valuation methodology in accordance with DIN 77100. On this basis, we use industry- and technology-specific licence rates and a market-based sales forecast including risk modelling to create a monetary patent valuation that is comprehensible and transparently documented for third parties.
Valid evaluation through norms and standards
Together with the Federal Ministry of Economics and Climate Protection (BMWK), the Fraunhofer Patent Centre and other SIGNO partners at the time, the SIGNO standard patent value was developed by us. This evaluates individual intellectual property rights qualitatively by means of statements on market, technology and legal aspects on the one hand and quantitatively by means of monetary patent valuation according to the licence cost analogy on the other.
It goes without saying that this standard conforms to DIN patent evaluation 77100, which an ATHENA employee was actively involved in creating.
In an EU project with various patent offices, we also co-developed the tool „IP Valuation Service“, which we exclusively support throughout Germany.
DIN-compliant and transparent valuation
Valid, well-founded and independent – at fair conditions
Patents and portfolios as corporate value
In other valuation cases, property rights can secure financing or serve as a contribution in kind for start-up projects. Here, too, we can often offer our objective expert opinions in accordance with the aforementioned methods for greater confidence in a technology and its secure monopoly protection.
This means:
- a higher probability for the positive outcome of bank discussions
- a greater chance of funding approvals
- a fair valuation of the „IP“ contribution for start-ups or the valuation of company shares
We optimise your patent portfolio!
We can also systematically determine values for larger patent portfolios. This is often used for the sale of technology divisions or complete company sales/liquidations.
Using indicator-based analysis and evaluation methods, we support you in maintaining and streamlining your patent portfolio. The abandonment of property rights and the identification of potential infringements, licence revenues to be generated outside the industry and the initiation of further property right applications in important areas are key aspects of the analysis.
